What is Zoning?

Zoning refers to the rules and regulations that dictate how land can be used in a city. These rules ensure compatible land uses, protect property values, and support community goals. For example, zoning determines whether an area is designated for residential homes, businesses, or industrial facilities.

Common Zoning Categories in El Dorado

• Residential (R): Includes areas for single-family homes, duplexes, and apartments.
• Commercial (C): Areas for businesses, offices, and retail spaces.
• Industrial (I): Zones designated for manufacturing, warehousing, and other industrial uses.
• Mixed-Use (MU): Combines residential, commercial, or other uses in one area to promote walkable neighborhoods.

How Zoning Affects You

• What Can You Build? Zoning laws dictate what types of structures or uses are permitted on your property.
• Property Changes: If you plan to renovate, build, or change the use of your property, you’ll need to ensure it aligns with the zoning requirements.
• Community Involvement: Residents can provide input on rezoning requests or special use permits in their area.

Rezoning and Special Use Permits 

• Rezoning: Properties can be rezoned to other uses through the rezoning process. This process includes the completion of an application, payment of a filing fee, public hearing with the Planning Commission, and official adoption of the Planning Commission’s recommendation. • Special Use Permits: Property owners can apply for a Special Use Permit for land uses not granted under current zoning. This application process includes a written application, application fee, site plan, public hearing, and action by the Governing Body. For more information on Special Use Permits and the process to obtain one read more in Article 10 of the Zoning Regulations or contact the Community Development Department at engineering@eldoks,gov.

What is Code Enforcement?

Code Enforcement is all about ensuring properties within the city comply with municipal codes and ordinances. These codes cover a wide range of issues promoting community health, safety, and aesthetics.   

What do we look for?

Our Code Enforcement Officers address various concerns, including:

• Property maintenance: We ensure properties are well-maintained and hazard-free. This includes:
  • Overgrown grass and weeds
  • Accumulation of trash and debris
  • Dilapidated structures
  • Unsafe or unsanitary conditions
• Junk vehicles: Inoperable or abandoned vehicles can become eyesores and attract pests. We work to ensure they are removed or properly stored.
• Nuisance violations: We address issues that disrupt the peace and quiet of our neighborhoods, such as excessive noise, illegal dumping, and improper storage of hazardous materials.   
• Building code violations: We ensure construction and renovation projects comply with the adopted building codes (ICC) to protect public safety.   
• Zoning violations: We enforce zoning regulations to maintain the character of our neighborhoods and ensure compatible land use.   

Why is Code Enforcement important?

Code Enforcement plays a vital role in:

• Protecting property values: Well-maintained neighborhoods attract investment and contribute to a strong local economy.   
• Preserving community aesthetics: A clean and attractive environment enhances the quality of life for everyone.   
• Promoting public health and safety: Addressing hazards and unsanitary conditions helps prevent accidents and protects community health.

How does Code Enforcement work?

1. Complaint or proactive patrol: We respond to complaints from residents or identify violations through proactive patrols of our neighborhoods.
2. Inspection: A Code Enforcement Officer will inspect the property to verify the violation.
3. Notice of violation: If a violation is found, the property owner will be notified and given a reasonable time to correct the issue.
4. Follow-up: The officer will follow up to ensure compliance. If the violation is not corrected, further action may be taken, which could include citations or legal action.
